Responsibilities

POSITION OVERVIEW:

Attorney with 10+ years of relevant pharmaceutical industry experience to join the Sanofi Legal Department as Senior Corporate Counsel responsible for products (both investigational and marketed) managed by Sanofi’s Specialty Care business unit, Sanofi Genzyme.  This role will focus on our immunology franchise, including some responsibility for our Dupixent® (dupilumab) franchise globally.  Candidates should have experience counselling in-house clients on the sale and marketing of pharmaceutical products, the intricacies and nuances of appropriate scientific exchange and other legal matters of importance to the pharmaceutical industry.  Experience supporting digital delivery of scientific engagement and promotional content, as well as advising on privacy laws, is a plus.  This position will report to  the Assistant General Counsel, Specialty Care and will be based either in  Bridgewater, NJ or Cambridge, MA. 

This position will serve as the primary legal contact for products described above within the Specialty Care portfolio; advise internal groups including Commercial, Sales, Medical Affairs, and others; focus both on global and US issues; and be a subject matter expert within the specialty care legal team for digital initiatives, working with the business and legal colleagues in other parts of the legal function to help ensure alignment across Sanofi.

Substantive working knowledge of US federal and state laws and regulations relating to the pharmaceutical industry, including US federal healthcare program requirements under the Food, Drug, and Cosmetic Act, the False Claims Act, the Anti-Kickback Statute, the Transparency Provisions (Sunshine Act) of the Patient Protection and Affordable Care Act, US Antitrust laws, and relevant privacy laws is expected.  Experience working globally, including a familiarity with the European Union’s General Data Protection Regulation and other laws and regulations applicable to the pharmaceutical industry outside of the US, is a plus. 

This role is an individual contributor role and will require coordination with other legal and compliance professionals in a global matrixed environment.

Candidates for the position are required to have a JD from an accredited law school and a valid license to practice law. A Massachusetts or New Jersey license is preferred.

KEY RESPONSIBILITIES:

Partnering with and advising senior business leaders to facilitate compliant execution of strategy and achievement of objectives, which could include (i) ensuring clients are kept abreast of relevant legal developments, (ii) advising on strategic initiatives and business operation plans, (iii) identifying and analyzing risks and proposing appropriate solutions to ensure compliance with law and company policy, (iv) coordinating and assisting in securing legal counsel from other Sanofi attorneys globally, and (v) providing specific US legal advice.

Primary areas of focus include (i) interactions with health care professionals and patients, including via digital initiatives, (ii) product promotional materials and initiatives, particularly including digital and social media, (iii) regulatory submissions and product labeling, (iv) advisory boards, speaker programs, and publications, (v) medical education initiatives, (vi) serving as a member of promotional and/or medical affairs review committees, and (vii) reviewing and advising on media relations materials, investor presentations, press releases, web sites, and other company communications.  

In addition, the role will require reviewing and interpreting agreements associated with the business, including agreements with health care professionals, vendors, licensors, collaborators, consultants, and speakers.  It may also include contract drafting and negotiating.

  • Ability to effectively communicate legal advice in a simple and straightforward manner, including the ability to: (i) understand and digest complex scenarios, (ii) identify and evaluate relevant legal issues and risks, (iii) propose solutions that take into consideration the relevant business objectives, and (iv) communicate issues, risks, and solutions clearly and concisely to lawyers and non-lawyers.

  • Ability to influence others without direct line management oversight.

  • Commitment to proactively identify opportunities for improvement and engage with appropriate stakeholders to propose solutions.

  • Ability to manage outside counsel effectively and efficiently, when used, and adhere to a budget.

  • Position may require travel to various sites domestically or internationally and will include other duties as assigned.

QUALIFICATIONS:

  • JD from an accredited law school and a valid license to practice law (Massachusetts or New Jersey license is preferred)

  • 10+ years of relevant pharmaceutical industry experience

  • Experience in digital health, social media, and privacy issues Experience counselling in-house clients on the sale and marketing of pharmaceutical products and legal matters of importance to the pharmaceutical industry
